A 48-year-old man who was arrested Sunday night at a Thornton movie theater where he wore a holstered weapon said he was simply exercising his right to bear arms.

James G. Mapes was arrested at about 10:15 p.m. Sunday at the Cinebarre Movie Theater, 1001 N. Grant St., after he openly carried a handgun into the theater, Thornton police said in a media release.

"The subject's possession of the firearm caused alarm to the theater staff and fellow movie patrons," police said in the release.

In the wake of the July 20 theater shooting in Aurora that left 12 people dead and 58 wounded, someone called Thornton police on Sunday night to alert them about Mapes and his side arm.

Officers responded, "evacuating several theaters as a precautionary measure," police said.

"The subject's possession of the firearm caused alarm to the theater staff and fellow movie patrons," police said.

He was booked on suspicion of "possession of a dangerous weapon," in violation of municipal ordinance 38-237, police said.

Mapes was issued a summons and released.

Investigators confiscated the gun as evidence in the case.

"This case is under review by our city prosecutor," said Matt Barnes, a Thornton Police Department spokesman, on Monday.

"We are an open carry state," Barnes said. "We look at the open carry law and how it relates to this incident. He felt he was exercising his right to bear arms in an open carry state, and we are currently reviewing that with our prosecutors."
If you are an open carry state this guy was obviously not breaking any law so you shouldn't have arrested him. I hope he sues for false arrest, but I have a nasty feeling that the city prosecutor will drop the dangerous weapon charge and go for disorderly or disturbing the peace charges.

Where was this tough guy the night of the shooting?

Question: If I saw this guy out somewhere just a couple weeks after the theater massacre, would I be self defense if I shot the guy and claimed that I saw his weapon and I feared for my life?

while he may be exercising his rights....pretty fracking stupid so soon after the CO massacre. this guy didn't help promote the second amendment at all. there is such a thing as common sense.
 
People should have the right to throw people carrying guns out in the open out of their establishment. It's like walking around naked - Jesus Christ, just don't do it.

If you truly were smart, you would know that Denver does not allow open carry, much to the dismay of your comrades.

Colorado was once one of our "Gold Star" open carry states. However, Denver filed and won a suit challenging the states excellent preemption law. Consequently, both open carry and unlicensed open car carry in Denver are prohibited. There are reports that other localities are planning to follow suit. Currently, outside of Denver, car carry is unrestricted and localities are almost completely preempted in enforcing firearms restrictions, and must post specific facilities which are off limits to open carry.
