They lost the case and are now appealing. That is hardly the same thing as a case still pending.


At this point the case is decided and the appeal is pending. The case is no longer pending since it was decided.
See State v Gamble. A case is no longer pending once a court has made a decision.
 
Case after case Rudy and the Rudeettes are losing, They are tossed out of court, almost like they are jokes. I never heard of a judge calling a case a Frankenstein case when he dismissed it. One dismissed an evidentiary hearing because it was a waste of time. So many are just laughed at by judges.

No there is no such proof. You just believe it because you want to. If Tudy had a scintilla of proof, don't you think he would have presented it in court? He just lost about 40 cases for no particular reason. He was keeping it for the big show? Make some sense.

The lawsuit is still pending. An appeal is part of the lawsuit. Irrelevant reference.
