Yale Law School professor Ackerman and Indiana University law professor Magliocca point to Section 3 of the 14th Amendment, aimed at preventing people from holding federal office if they are deemed to have “engaged in insurrection or rebellion” (this dates from the post Civil War period, but it’s still there).
If a simple majority of both houses vote that Trump engaged in an act of “insurrection or rebellion,” then he would be barred from holding federal office.

It's purely a political move. It will be worse this time if the Dems can't convict him
How so, the Dems will have every Republican on record that they support insurrection. Elections are in 2 years, in some places being a trump pawn will be good for their career in other areas it will spell the end of their time in office.
Calling it insurrection doesn't make it insurrection.
True, it requires one to actually take action and that criteria was met.
