Wisconsin Collective Bargaining Law Struck Down By County Judge

MADISON, Wis. — A Wisconsin judge on Friday struck down nearly all of the state law championed by Gov. Scott Walker that effectively ended collective bargaining rights for most public workers.

Walker's administration immediately vowed to appeal, while unions, which have vigorously fought the law, declared victory. But what the ruling meant for existing public contracts was murky: Unions claimed the ruling meant they could negotiate again, but Walker could seek to keep the law in effect while the legal drama plays out.

The law, Walker's crowning achievement that made him a national conservative star, took away nearly all collective bargaining rights from most workers and has been in effect for more than a year.

Dane County Circuit Judge Juan Colas ruled that the law violates both the state and U.S. Constitution and is null and void. He said the law violated the constitutional rights of free speech and association.

The ruling applies to all local public workers affected by the law, including teachers and city and county government employees, but not those who work for the state. They were not a party to the lawsuit, which was brought by a Madison teachers union and a Milwaukee public workers union.

Walker issued a statement accusing the judge of being a "liberal activist" who "wants to go backwards and take away the lawmaking responsibilities of the legislature and the governor. We are confident that the state will ultimately prevail in the appeals process."

:D

Walker could seek to keep the law in effect while the legal drama plays out.

The ruling means that local government and schools now must once again bargain over those issues, said Lester Pines, an attorney for Madison Teachers Inc. that brought the case.

"We're back to where we were before the law was enacted," he said.

Pines predicted the case would ultimately be resolved by the state Supreme Court.

"What's going to happen in the interim is unknown," he said.

Republican Rep. Robin Vos, a staunch supporter of the law and the presumptive next speaker of the Assembly, called the ruling an example of the "arrogance of the judiciary."

"I'm confident it's a single judge out of step with the mainstream," Vos said.

He said the law is working "and we'll continue to implement it."

When a judge rules against Koch-financed special interests, they're "liberal activists" and "black-robed tyrants"...but when they rule in favor....

I guess you missed the part where activists judges make shit up and get over turned...

I guess you are a wishful thinker. Good luck with that.

Strong unions are the only chance this country has left. Bright as you purport yourself to be, surely you realise that this kind od income disparity cannot end well.

The wishful thinkers are those in the union who think they can continue going to the liberal judges in Dane County to try and subvert the legislature by selecting the right like minded judge.

Unions, like many things, have their place. They most certainly were a benefit to this nation in the past. That said, like anything, they can become corrupted. Now many unions go to the extreme. Now many, like the Chicago teachers, are unrealistic in their demands. Those in WI are also delirious, as is this judge from Dane. To say their rights to associate or rights of free speech are being violated is pure nonsense. They still have the right to collectively bargain... it just isn't with the politicians any more. It is with the tax payers.
