So, a kid with an assault rifle in violation of a curfew order and breaking a law.... a okay. A guy trying to break up a fight.... shoot him in the back seven times. Cool, got it.

The courts will resolve each. My guess is both shooters will be doing time. I was going to say "taking a hit", but that might come across as flippant even though it's true.

I suspect you're right. The bottom line is that regardless of the ultimate outcome, neither one should be cast as a hero.

Agreed, which is why one is being charged (overcharged IMO) and one is under investigation and will probably be charged....maybe only for the last four shots.

I know you said this before, but first degree felony reckless homicide seems appropriate to me. Which element do you think is missing from this? I'm curious.

That's the first and most severe count he's charges with. It seems appropriate to me.

Kyle didn't appear to plan to murder anyone. Unless you have proof then it's not premeditated.

Example: Last December's West Freeway Church of Christ shooting involved defenders who brought guns to church and one of them, Jack Wilson, shot and killed the attacker. By your definition, Wilson is guilty of First Degree Murder. He wasn't.

Agreed, hence second degree murder. Let's not forget a criminal conviction is beyond a reasonable doubt. The fact I'm even suggesting second degree since there is no first degree evidence, is "beyond a reasonable doubt".

Example: Zimmerman case. That one at best was manslaughter but zero convictions because they overcharged and couldn't prove their case beyond a reasonable doubt. We, the People shouldn't be trying criminals cases by simple majority vote.

Use some abstract thinking here. Dems have been wholeheartedly pushing for lack of police and defunding thinking they can do a better job by themselves. That kid did some self policing. Now Democrats are panicking. They do that to themselves all the damn time.

Tell me, if the Parkland shooter had been hit in the head with a skateboard after his first killing, would you call it self-defense if he shot the person wielding the board?

Did he initiate the violence, or was it the students?

Since you're slow, the skater wasn't even the first retard against whom Rittenhouse defended himself.
