This is not complex. When we start seeing outbreaks in high immunity communities unable to sustain themselves, we are near herd immunity. We are not seeing that yet, and may never see that.
It is actually about not sustaining an outbreak. An epidemic is a rapid spread, which does not need to be happening to disprove herd immunity.
But lets look at a country further along the timeline towards natural herd immunity. Would you consider India to have herd immunity, or be very close to herd immunity?

Your "unscathed" statement is based on wishful thinking. You need India and Brazil to be unscathed to explain their lack of herd immunity. The fact is that they had extreme outbreaks, but those outbreaks did not cause lasting herd immunity.
The best current evidence is that natural immunity to Covid-19 fades quickly, so that means NYC could have another wave easily, unless vaccinated immunity is much better. No one knows how good vaccinated immunity is.
