It's very likely they weren't since there is not an indictment released charging them.

The indictment says co-conspirators sent money overseas. It does not allege Abrego Garcia did that.

Perhaps you meant the third paragraph which says nothing about moving money overseas but only says the co-conspirators moved money between themselves. You will note it doesn't say Abrego Garcia passed money to other co-conspirators.

I do love the allegation that part of the conspiracy was to travel without luggage. Did you know it is illegal to travel without luggage in the US?

If he's a co-conspirator, then he is equally culpable for their sending money overseas. That's how conspiracy laws work. The getaway driver in an bank robbery is a bank robber even though he never entered the bank.

In a conspiracy, all the conspirators are equally libel for all charges brought. That means if others in the conspiracy did something to further the conspiracy, then every conspirator can be charged with that crime. The claim made about travelling without luggage was evidence presented to show that those doing so were being smuggled and not simply construction workers who would normally be expected to provide their own set of hand tools for example.

It could be the indictment wasn't artful in it's language but as written, it means one element of the conspiracy was not carrying luggage. You can't conspire to do something that is legal. It is not illegal to not have luggage.

As an interesting side note. As found by a law professor, DOJ documents from 2022 already dispute one of the claims in the indictment. The 2022 document states that Abrego Garcia said he was coming from Houston three days prior on his way to MD via St Louis. The indictment claims he never said anything about TX but claimed he had been in St Louis for 2 weeks. That is a pretty big error in the indictment and in information given to GJ.

Actually, conspiracy charges are hard to beat. All that's needed by the prosecution is to show a solid link between the conspirators and after that, the defendant is pretty much fucked.

The claim in the indictment is no indication of what will be actually presented at trial beyond an outline. You are focused on something that is a minor detail here.

I never said they didn't indict. I said that the job of a grand jury is not to decide the evidence is true. They only decide if the evidence as presented is enough to indict. Go back and read my post.
