I've never understood her defense. She claims she mistook her yellow taser which feels one way in the hand for her black revolver which feels a different way in the hand and her mistake caused the victim's death. That is
the definition of negligent homicide.
In the heat/excitement of the moment she fucked up. She was reacting, not thinking. She killed an innocent man so she has to pay but it wasn't negligence except on the part of the podunk police department of 26 officers who trained her, who qualified her, who put a gun in her hand and put her on the street.
Let's not forget that, despite her years of service this was the first time she'd ever pulled her gun or taser on the street. My guess is that her podunk police department didn't have an annual combat training program.
I've seen pilots, in an emergency, do exactly the wrong thing. This is most often seen in training simulators and post-accident analysis. A common one is pulling back the wrong engine lever when one fails. Others are pulling back on the yoke/stick during an engine failure precipitating a stall.
The 2009 crash at Buffalo, NY was an example of a fatigued, minimally qualified crew killing 50 people where the Captain did exactly the wrong thing. The USAirways Hudson accident was where, except for hitting the birds, the crew did well.

She was the best judge of whether she was capable of "ordinary prudence" in the "circumstances" that confronted her as an officer. She chose to act in that circumstance. Classic criminal negligence. To blame her trainers is, pardon the expression, a cop out.
