She wanted to get a shot of the gun pointed at the camera, which is a common shot in films. She then lined her own head behind the camera. The bullet fired through the camera and into her.

Hutchins, quite reasonably, had the gun pointed at the camera, and her own head in the line of fire of the gun. The only problem here is that Gutierrez-Reed replaced the fake gun with a real gun that was loaded.

To prove murder against Baldwin, you would have to prove that he knew the gun was a gun, and that it was loaded. All testimony so far is completely the opposite of that.

No, it went through the camera and hit her. Baldwin was not aiming, but Hutchins was. Her aim was perfect, which turned out to be unfortunate for her.
 
I do not believe Baldwin has any prior violent crime convictions. Do you have any evidence of your claims?

It seems he has repeatedly been arrested for assault, has had to pay damages in civil court to victims of his actions, but has managed to avoid actual criminal conviction. Those previous arrests will however count against him if he's found guilty when it comes to sentencing.

So you're saying Baldwin saw the gun and thought it was a banana. And the VERY first thing that teach people about guns is assume EVERY gun is loaded and handle it accordingly. And related you are taught to NEVER aim it at anything or anyone unless you intend to shoot whatever you are aiming it at.

He was clearly told that it was not a gun. It would be a fake gun, which is common on the sets of movies. Both sides in the trial agree on that fact.

So the question becomes, how did Baldwin form intent with a fake gun. The prosecutor has to prove that Baldwin had a clear plan to turn the fake gun into a real gun through some form of magic. When you have to prove the impossible to get a conviction, there is no conviction forth coming.
 
No, they really do not. It is only convictions that count against him at sentencing. Baldwin has no convictions.

Where it would bite him is that while his sentence wouldn't be longer, he would be considered to have a past history of violent acts and his security level in going to prison would be increased. This would put him in a more secure, and in many ways, more dangerous position while in prison.

So you admit that his complete lack of convictions will not be able to hurt him in either the guilt or the sentencing phases of the trial? Well that is a step in the right direction. They need to prove a likelihood of violence, or escape to get a more severe prison, and also prove that it is less likely that Baldwin would be the victim of violence. Good luck with any of that.
