To prove murder against Baldwin, you would have to prove that he knew the gun was a gun, and that it was loaded. All testimony so far is completely the opposite of that.

So you're saying Baldwin saw the gun and thought it was a banana. And the VERY first thing that teach people about guns is assume EVERY gun is loaded and handle it accordingly. So the question becomes, how did Baldwin form intent with a fake gun. The prosecutor has to prove that Baldwin had a clear plan to turn the fake gun into a real gun through some form of magic. When you have to prove the impossible to get a conviction, there is no conviction forth coming.
