Judge Acquits January 6 Defendant: ‘Reasonably Believed’ Capitol Police Let Him In

The only way Trump would nominate a good judge would be by accident.

Amie Coney Barret? The other Justices he selected, We'll see if they are good judges or not! I'm really not the one on their case- YET!

He may have actually made some good choices there by accident!

from what I heard from Sen. Tim Scott on the news this morning, Biden's first pick has a long list of cases overturned on appeal.......

Referred to appellate courts is one thing- does not mean "overturned on appeal"! Watch your wording you slimy snake!

Doesn't mean they will be overturned does it?

you do like to dream, don't you? it's funny how you look at all non leftwingers, like you(sarcasm), as terrorists or supporters ROFL

haven't you wondered why I haven't been arrested yet, after you reporting me to the FBI like a karen?

The only people I look at like they are terrorists are terrorists. The fact you can't tell the difference between a freedom fighter and a terrorist was significant.

Also significant was your defense of blowing up a daycare center as "collateral damage" such as your hero McVeigh did in Oklahoma.

It was an easy power for Trump to exercise. He was repeatedly asked to stop the insurrection. Trump organized the rally at the same time the electoral college votes were being counted. He scheduled the speakers who were rousing up the people to anger. Trump told them to march on the capitol and said he was going to go with them. THAT is the cause of the insurrection. Trump owns that riot and you are flat out wrong.

Trump had dozens if not hundreds of rallies. Pelosi was in charge of the House; she owns that debacle. :rofl2:

considering the numerous things you've been wrong about for the last 6 months, your opinions about things are highly suspect..........like knowing who is a terrorist, thinking others don't know differences, and excusing governments collateral damage while condemning citizens use of the same ROE as terrorism...........

you should probably surrender all your guns to the local sheriff and prostrate yourself in service to the whims of the DNC/RNC............i.e. the establishment. you certainly don't consider fighting for freedom as a high priority

Nice dodge, dude, but you know very well you're excusing murder for political purposes.

Sure, I'm not happy with the state our nation is in either, but you want to burn the Capitol and I think it's better to build on common ground.

You look at killing as a means to achieve your objective whereas I see it as a last resort in achieving an objective.

There's a big fucking difference between a military which seeks to minimize all casualties, even military casualties, versus a "militia" who targets Federal buildings full of civilians and daycare centers right after rush hour.

Kill all terrorists and their supporters.

Hello Dutch,

They may have been under orders or just overwhelmed to the point they gave up. I'm certain all the officers and their actions that day have come under scrutiny.

Let's not forget the Capitol is a very large building with multiple entrances. With all the hours of violence by Trump's Terrorists, maybe the police force collapsed by being overwhelmed. I don't know but am certain it's been looked into.

They were being improperly led. They were told to be on the lookout for anti-Trump protestors. The directive should have been for people breaking the law, period. It is wrong to police differently depending on politics. Trump supporters should not have been allowed pas the barricades, period. At no point did it 'become OK' because others had done it. Wrong is wrong. Two wrongs do not make a right.

you still think there's hope. how naive ROFL..........

Who was the President ordering this? LOL

On Wednesday, a federal judge acquitted a January 6 defendant on all charges after ruling that the New Mexico man “reasonably believed” he was allowed to enter the Capitol building during the protest against the 2020 election results after being let in by United States Capitol Police officers.

Judge Trevor McFadden “issued the verdict from the bench after hearing testimony without a jury in the case against Matthew Martin,” The Washington Post reported.

Martin was the first January 6 defendant to testify in his defense trial and argued that Capitol Police allowed him to enter the facility. According to the Post, Martin “said he ‘went with the flow’ as he approached the Capitol and testified that he saw a police officer wave him into the building.”

He was in the Capitol building for roughly 10 minutes on that day.

The Post reported:

Martin was charged with four misdemeanor counts: entering and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, violent entry and disorderly conduct in a Capitol building and parading, demonstrating or picketing in a Capitol building.

Buzzfeed provided more details behind McFadden’s verdict:

Announcing his decision from the bench, US District Judge Trevor McFadden said that although prosecutors argued there were numerous instances when Martin would have been aware that he wasn’t allowed on Capitol grounds or inside the building — as he walked past fences with signs saying “AREA CLOSED” and recorded video of a broken window, blaring alarms, police in riot gear, and people who appeared to have encountered tear gas — those were outweighed by Martin’s “plausible” belief that he had permission because officers didn’t try to stop him from entering.

McFadden said that Martin’s conduct was as “minimal and non-serious”as the judge could imagine for someone who went into the Capitol on Jan. 6. He said that Martin seemed to be a “silent observer” of the scene and didn’t try to crowd the police, protest, or wave the “Trump” flag that he was carrying. Martin appeared “quiet” and “orderly” as he walked inside the building, filmed video inside the Rotunda similar to how the media would behave, and didn’t appear to interfere with officers as he filmed a clash with rioters later in the afternoon on a north terrace of the building.

According to The Post, “More than 770 people have been charged with riot-related federal crimes. Over 240 of them have pleaded guilty, mostly to misdemeanors, and over 140 of them have been sentenced.”

As noted by Buzzfeed, the verdict “represented an early test of efforts by some Jan. 6 defendants to argue that police allowed them to enter the Capitol, or that they believed they had permission because no officer told them to stop.”

I can see that for some of the insurrectionists.

you're still not getting it, are you? how did you become an officer? was your degree in liberal arts or chinese history or something?

What's to get? That you consider murdering children to be A-OK with you as long as it serves the purpose of attacking the Federal government?

whats to get? that you don't see whats coming? I assure you that the 'other' side isn't going to give a fuck about you or kids when they start shit, and your precious federal government isn't going to give a fuck either. They will surely blame your 'enemy' and you will act like a simp and side with the government like a good little subject..........will you then accept the deaths of kids when it suits your purpose of a totalitarian state?
