No- Palestine is a UN-recognized state, recognized on the pre-1967 borders by 138 countries and sharing the same legal right to exist as Israel.

No- the Zionist terror gangs had attacked over 400 Palestinian villages before the Arab League attempted to intervene. In addition, losing does no change the law. Even though the Arab states voted against partition at the UN the resolution still PASSED. Palestine is a legal entity.
