"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
This amendment applies ONLY TO CONGRESS (and therefore the rest of the federal government). It does NOT apply to State governments or city and county governments. This amendment does not confer any right.
"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."
This amendment discusses two related inherent rights:
1. The right of a State to defend itself. It does this by forming militias.
2. The right of the people to defend themselves (individuals). They do this by bearing Arms (weapons). That means ANY KIND OF WEAPON, including ANY KIND OF GUN.
This amendment does not confer any right. It PROHIBITS the federal and state governments from infringing on this right. This amendment applies to ALL layers of government.
You are also ignoring the State constitutions, which all contain a similar clause, to be applied to the State government as well.
