THAT is why the Supreme Court voted unanimously that he had to be brought back - because his right of due process was violated.

If all of the allegations against him are true, then bring him back and try him, per the Constitution, and then we can deport him - this time legally.

Discovery was supposed to be completed by April 23 but after the government filed a motion under seal the plaintiff's lawyers agreed to extend discovery until April 30. It's unclear why. The judge had just issued a ruling that the government was not complying with court orders on discovery prior to this ruling.
