The evidence is that Comey is such a threat that they not only didn't indict him until over a year after he posted that picture and then they didn't argue for any bail because he was a threat. It's rather hard to argue he was a threat to the President based on those facts and yet that is what they will have to argue in court to convict him.

There's not a judge alive that would keep anyone charged with the same crime in jail with no prior record. Nobody is complaining about either. MY guess is the when the judge rules that Comey is entitled to grand jury proceedings to see if the law was followed DOJ drops the case. Just like they did in Chicago for those accused of conspiracy.
