The first coronavirus death in Washington — and the U.S. — was announced Feb. 29, 2020. The King County man was in his 50s and had an underlying health condition. He was a patient at EvergreenHealth hospital in Kirkland.


The letter (seen above) was issued nearly three weeks after a Chinese disease outbreak decimated a nursing home in Kirkland, killing the majority of residents. As a result, Washington was the initial epicenter of the virus in the US.

The Washington State Department of Health was already aware of the risks posed by the Chinese disease to elderly Americans and had issued relevant guidelines even before they told facilities to take infected patients in order to receive additional funding.

Criminal charges possible against Governor Whitmer over nursing home deaths


Criminal charges could be in the works against Governor Gretchen Whitmer over putting COVID patients inside nursing homes used as hubs early in the pandemic.

Prosecutor Peter Lucido says people who lost loved ones to COVID as residents or staff inside nursing homes should go back to get the vital information about the circumstances of their death and take that to local police and make a complaint as a wrongful death.

This nursing home is at the center of Washington's coronavirus.


When first responders reported to a hard-hit nursing home in Washington state, the epicenter of the nation's coronavirus outbreak, they found an understaffed facility with inadequate gear attempting to serve dozens of patients vulnerable to catching the virus.

Just three staff members reported to Life Care Center in Kirkland, Washington, between Tuesday night and Wednesday morning to serve about 90 residents, a first responder familiar with the situation told CNN.

Still, neither the King County Health Department nor the Centers for Disease Control and Prevention sent personnel to provide assistance -- though they have since.

First responders were concerned that staff members were not wearing appropriate personal protective equipment to handle the high number of patients with probable coronavirus.

They also arrived to find employees using positive pressure bag valve masks to ventilate potential coronavirus patients -- even though firefighters have been told not to use such masks, as they can disperse more particulate into the air, the responder said.

The children and other relatives of patients in the facility had been attempting to sound the alarm about conditions in the facility for weeks.

CNN reached out to the county medical services officials, Public Health Seattle-King County, the Washington state Department of Health and the CDC for reaction.

A DEMOCRAT governor was responsible

Life Care Center of Kirkland, home of the first COVID-19 outbreak in the U.S., received vaccines for nursing home staff and residents on December 28, 2020.

Life Care Center of Kirkland was the epicenter of U.S. COVID-19 cases at the beginning of the pandemic. There were 101 confirmed cases among residents and 55 confirmed cases among staff, reports King County Public Health.

Life Care Center experienced two outbreaks at the Kirkland facility this year, which resulted in a total of 46 deaths among residents, staff, and visitors. Some families have brought legal action against the facility, claiming officials didn't do enough to reduce risk.

Whitmer's administration sued

The Mackinac Center Legal Foundation filed a lawsuit against the Michigan Department of Health and Human Services after the department refused to release data related to COVID-19 deaths at nursing homes. The Center is representing Charlie LeDuff, a Pulitzer prize winning journalist, who was denied state records after submitting a Freedom of Information Act request in January.

Given the recent exposures of nursing home policy failures in other states, it has become even more critical that the state be transparent. In December, the state’s COVID-19 dashboard added an asterisk to its data, claiming new death numbers were found as part of a vital records search. LeDuff filed a FOIA request on Jan. 27, 2021, asking for a listing of all Michigan COVID-19 deaths during the month of December 2020 that were identified in the vital records search.

The department responded by providing a link to the state’s website, which contained summarized data that had previously been released publicly. MDHHS refused to release any additional information, claiming that it would be a privacy violation. LeDuff then clarified that his request needed to only provide the age and date of death, as well as when the death was added to the department’s official statistics and if the deceased contracted COVID-19 at a long-term care facility. But he was once again denied.

Despite the request being for aggregated and anonymized data, the department claimed that releasing it would reveal protected and private health information. The department also refused to release information on the grounds that the requested data was drawn from vital records, making it exempt from disclosure by law.

“It is essential that the public have access to data about nursing home deaths in Michigan,” said Steve Delie, the Mackinac Center’s policy lead on transparency and open government. “Unfortunately, rather than simply providing anonymous data, the state has refused to shed light on this important matter. As more scandals plague other states’ COVID response, it is no longer acceptable for the government to provide statistics and ask citizens to simply accept them as true.”

It should be noted that MDHHS sells copies of individual death certificates that can be obtained by anyone and that contain more personal information than LeDuff is requesting. Despite the department’s claims, none of the requested information can realistically be used to identify individuals. In addition, FOIA permits that specific identifying information can be redacted from the data and the remaining information can still be released. Even if privacy is the main concern, the department could simply redact parts of the information and release the rest.

DEMOCRAT Governor Jay Inslee’s Department of Social and Health Services issued directives to "transition" COVID positive patients to primarily to "alternative settings" with nursing homes being the "primary strategy" in order to "create capacity for hospitals."

Nursing homes that admitted COVID positive patients were offered Medicaid funds.

Inslee was already issuing proclamations recognizing the need to protect people aged 60 and older from the virus—which begs the question why a department under his authority was asking for nursing homes and care facilities to take COVID positive patients.

Cuomo's nursing home scandal raises questions for SUNY chancellor

James Malatras helped draft report that undercounted COVID-19 deaths connected to nursing homes.

Malatras, a longtime adviser to the embattled governor, helped draft the state's report on COVID-19-related nursing home deaths that was found to have undercounted victims and, as a result, he is now a subject of an investigation by the FBI and the U.S. attorney's office.

Malatras was a key figure in Cuomo's COVID-19 task force.

Cuomo's false claim about Covid-positive patients and nursing homes

Cuomo said that nursing homes "never needed" to accept Covid-positive patients from hospitals in the state due to a shortage of hospital beds.

During a press call Wednesday, Finger Lakes News Radio asked Cuomo about his administration's advisory in late March requiring that nursing homes accept the readmission of patients from hospitals, even if they were positive for Covid-19.
The governor's office has repeatedly said the advisory was based on federal guidance, which prohibited discrimination based on a coronavirus diagnosis. The state's Department of Health told CNN, "Residents were admitted to nursing homes during that time not as an overflow facility, but because that's where they live."

Cuomo said that the advisory was a precaution if hospitals became overwhelmed -- calling it an "anticipatory rule" -- which he said didn't happen.

Cuomo's assertion that "it never happened" is false. According to a report from the New York State Department of Health, "6,326 COVID-positive residents were admitted to [nursing home] facilities" following Cuomo's mandate that nursing homes accept the readmission of Covid-positive patients from hospitals. Whether or not this was "needed," it did in fact happen.

In March 2020 an Army field hospital was established at Century Link (now Lumen) Field for non COVID patients, was re-deployed elsewhere due to a lack of patients.

DEMOCRAT Governor Jay Inslee said at the time the field hospital was requested due to concerns that local hospitals would be overwhelmed with COVID patients and unable to care for everyone who needed medical attention. He also said the request was made prior to the full implementation of distancing measures.

Governor Inslee expanded the directives he made for nursing homes to long-term care facilities on March 26.

In proclamation 20-36 on March 30, almost a month after the outbreak in Washington nursing homes, Inslee mentioned in anticipation of hospitals being overwhelmed a need to "waive portions of licensing statutes and rules" so healthcare facilities could provide alternative beds for COVID patients.

According to the Seattle Times, "nursing homes, assisted-living facilities and adult family homes, account for half the state’s deaths."

Yet as of February, data was still being inaccurately reported regarding long term care facilities.

On March 25, 2020, DEMOCRAT Andrew Cuomo's Health Department issued an advisory requiring nursing homes to accept "the expedited receipt of residents returning from hospitals",

"No resident shall be denied re-admission or admission to the [nursing home] solely based on a confirmed or suspected diagnosis of COVID-19," the advisory stated. "[Nursing homes] are prohibited from requiring a hospitalized resident who is determined medically stable to be tested for COVID-19 prior to admission or readmission."

On May 21 The Associated Press reported, "More than 4,500 recovering coronavirus patients were sent to New York's already vulnerable nursing homes" under the state's advisory.

In July, the state's Health Department released a report that found "approximately 6,326 COVID-positive residents were admitted to facilities between March 25, 2020 and May 8, 2020."

But the Cuomo administration dramatically downplayed the toll the virus exacted on nursing home residents, thanks to the intervention of top aides to the governor.

The failing New York Times reported that Cuomo officials were made aware that more than 9,000 nursing home residents had died of COVID-19 by June—a number significantly higher than the next closest state—but rewrote the Health Department’s report to omit the tragic figure.

Since January 25, there have been 108 immigrants who tested positive for COVID-19, which is a 6.3 percent positivity rate, according to Brownsville spokesman Felipe Romero.

Immigrant families who tested positive at the bus station said they were waiting to travel to places such as Maryland and New Jersey.

After Border Patrol release, asylum-seekers test positive for Covid in Brownsville, Texas


A number of migrants seeking asylum and released by Border Patrol have tested positive to Covid-19 tests in Brownsville, Texas.

Some plan to continue their journey to other cities and states.

Miriam Izaguirre, a 35-year-old asylum-seeker from Honduras, crossed the Rio Grande at dawn Monday with her young son and turned herself in to the authorities.

A few hours later she was released, and the first thing she did was take a rapid test for Covid-19 at the Brownsville bus station. They told her her test came out positive.

"Right now we were tested for Covid and they separated about eight of us because we were positive," she told Noticias Telemundo Investiga. "We are waiting right now." She was waiting to catch a bus to Houston.

Other migrant families who also said they had tested positive were waiting to go to other destinations: North Carolina, Maryland and New Jersey.

The city of Brownsville administers these rapid tests at the bus station, after migrant families are released by the Border Patrol. A spokesperson for Brownsville confirmed that, since they began doing these tests Jan. 25, 108 migrants have tested positive for Covid-19, which is 6.3 percent of those who took the test.

In response to Noticias Telemundo Investiga, a spokesperson for the city said in an email that Brownsville does not have the authority to retain these migrants who plan to travel to dozens of cities throughout the country.

In Michigan, the more than 5,500 deaths in long-term-care facilities account for a third of COVID deaths in the state — as far as we know, given lack of transparency from both DEMOCRAT Governor Gretchen Whitmer and the state Health Department.

Whitmer refused to back down for months from her initial executive order instructing nursing homes and other similar facilities to take on hospital patients with COVID-19.

The governor was warned early on by the head of the state’s elder-care association not to do this, but she did so anyway. And she continued the misguided policy, despite several bipartisan attempts from the Michigan legislature to alter the mandate.

It wasn’t until late September that she changed course.
