According to the law a document doesn't have to be officially classified with a C in order for an individual to know whether said information is classified or not.

For example, if Obama were to send Hillary an email that said "We are attacking Osama Bin Laden tonight" and it were not marked Classified, do you honestly think she would look at it and say "Fuck, I guess I can tell anyone"?
