He stood his ground?!! (Not?!!)

I don't understand this whole thing obviously, but the first thing I don't understand is - who gives a flying fuck if someone is texing at the movie theater???? Talking on the phone yes. Their phone is ringing? Yes. I see people texting all the time at movies, and this happened during the damned previews! I think most people are still texting during previews, or making out. I mean, no one is actually watching them are they?

I'm just amazed that anyone would even care enough about someone texting to even say something about it, no less murder them for it.

In answer to your first question; a 71 year old retired cop who is carrying a gun and will shoot you if you don't stop it. But evidently you aren't the only one with questions. This man and his son were sitting next to the victim and had blood on their clothes as they left the theater and he was also shocked. "I can’t believe people would bring a pistol, a gun, to a movie," Cummings said. "I can’t believe they would argue and fight and shoot one another over popcorn. Over a cellphone."

More guns = More Gun Deaths

I don't either and I sure hope the police and prosecuters see it that way too.

His defense lawyers are already arguing for SYD; apparently it will be up to the Florida jury to decide whether a retied police officer feared for his life. I'm sure he did! How could he not? He was a cop, copes are trained to fear for their life! That is their job! He feared for his life everyday! There are bad guys out there and sometimes bad guys go to the movies? You can never be too careful and one popcorn is throw if you have a gun you must defend yourself. It's the law of the jungle survival of the fittest. Without the SYG gun laws we could be overrun by Hitler oh, I know he's dead, but haven't you heard of reincarnation!

He's going to go for that.

If they were both white, it probably won't work.
If the victim was black, it will work.
If they were both black, it probably won't work.

There's a reason black people call this the "shoot the n and walk" law.

The fox story said his lawyers argued for it at the preliminary hearing but the judge still refused bail, but he will try to use it, since he is a former cop, he might walk. Cops have a special place in the hearts of people who are asked to serve on juries. I would say it is probably a toss-up that he will be convicted.

IVAN IS IN MUCH AGREE WITH THIS. ONLY AGENTS OF STATE, SUCH AS BRAVE MOVIE PATRON, SHOULD BE OF HAVING WEAPONS. IF ONLY STATE HAS GUN, STATE HAS NO NEED TO FEAR, AND THEN HAS NO NEED TO SHOOT. IF STATE HAS NO NEED TO FEAR OR SHOOT, IS BEST. SUCH IS WAY OF SUPERIOR MOTHERLAND, AMERICA HAS MUCH TO OF LEARN.

I support gun rights but too many people use guns because they cannot or are afraid to fight. At least if you fight you live to fight another day. Was this really worth it for the guy to spend the rest of his life in prison?

How do you know he is going to prison? It is Florida, where Zimmerman is still free!

Do we know he was going to attack the old man? The guy is an idiot no doubt. Who the hell throws popcorn at an old man? But throwing popcorn is no guarantee he was going to attack him. Nor is that justification for shooting.

The jury will decide that. And in Florida who knows if that will prove to be the case. "Under Florida's stand your ground statute—an expansive cover-all advanced by the state's top NRA lobbyist in 2005—anyone can shoot to kill, assuming they reasonably feared for their physical well-being. And the definition of "reasonably" is quite elastic, law professor Charles Rose" said.

In other words, it is possible and the man was an ex-cop so he probably knows the arguments well enough to walk. It depends how much outrage this generates and what the jury looks like! I wouldn't say he is going to jail yet. Zimmerman is still free! He was acquitted! This man may be too. Obviously the victim was white or they would be showing his picture. So they defense won't be able to present the victim to the jury as the "black beast rapist" so that should change the dynamic a little, but this guy isn't a cop-wannabe he is a retired cop, who created the SWAT team for the city. So he knows when to shoot and when not to shoot. Or at least that is the story the defense will tell and after Zimmerman I would say this guy has a greater chance of walking than going to prison.

I'm going to go out on a limb here and suggest that you would certainly fail my social response test.

We hope he would! Apparently he is either a braggart or he has guns and would kill you for looking at him cross-eyed.

More guns = More gun deaths!

I'm not disagreeing with that in the least.

You and Cwacko seem to have made up your mind though, ready to hang this guy.

So am I, but it is Florida and the man is an ex-cop and the law is "elastic" and it's hard to say given this states SYG law whether this man will be convicted. In the first place they have 6 jurors instead of 12 so it is a smaller group of people and that means there are fewer people to convince of his innocence.

And neither were Y-O-U.

But did that stop you from proclaiming:

No basis in fact...just a pathetic ASSumption from another know-it-all Rightie.

Most of what he said he read somewhere. The rightie didn't think any of that, which you have already quoted it was nearly directly taken from the story that Darla linked to on Gwacker! The defense attorney's are apparently already positing and planning the SYG scenario!

Kindly cite, dear woman, where I claimed to know the WHOLE story.

His quote doesn't say you knew the "WHOLE story" what he says is you cannot know what you claimed you knew, that is, why the younger man threw the popcorn, but you didn't know that you just read that it was something his defense lawyers were saying and decided it sounded good so you would use it, too!
