How arbitrary can those terms be?
150% arbitrary. The feds have no obligation to fund a private university for a single fucking thing. The university, if it wants federal funding, has to agree to federal stipulations and conditions to get the money. The same goes for conservative private universities, most of which simply don't take federal funding because it usually slants heavily Left on those conditions.
 
Harvard has ZERO right to federal funding if it won't agree to the terms the feds want in exchange for that funding.
Mr Jaffer points out that Title VI of the Civil Rights Act, which the administration has invoked on behalf of Jewish students and faculty, does allow for sanctions—but only after a formal investigation. Even then, “The remedial measures have to be limited to the programme found to be in violation.”

The law says differently.
