The 9th pertained to the states – so it is not possible to incorporate what was already incorporated so to speak

By laws I assume you mean applying the rights in the Bill of Rights to the states. All of those rights still do not apply.

The 9th referred to the enumeration of certain rights which refers to those enumerated in 1-8. Those 8 amendments only applied to the federal government so there was nothing to apply to the states.

well sure - the constitution was to limit their powers -not our rights. it is silent about the rights of the pregnant or the unborn - citizenship is defined as happening after being born or naturalized - not conceived, so the unborn is not a citizen yet I wouldn't think
