Iowa Supreme Court : Can't Ban Gay Marriage

The Iowa Supreme Court has ruled a ban on gay marriage is unconstitutional.

The Iowa Supreme Court says the state's same-sex marriage ban violates the constitutional rights of gay and lesbian couples, making it the third state where gay marriage is legal.

In a unanimous ruling issued Friday, the court upheld a 2007 Polk County District Court judge's ruling that the law violated the state constitution.

I'd be interested to know precisely which part of the state's constitution makes it untenable and to know if there's a corollary in the nation's constitution or legal precedent.

When you cut and paste the text it gets rid of the links that are embedded into the blog. Sometimes I put them back in manually, but it's rather time consuming, and I always get the feeling that no one uses them anyway, and that no one knows they're there anyway because the default theme makes links the same color as text.

I'm not surprized. I lived in Iowa in the Quad Cities for 7 years and I can tell you two qualities those Hawkeyes are famous for. Their hospitality and their fairness. Your typical Hawkeye would more than likely consider gay marriage a private matter between two people and it would only be fair to mind your own business about such a matter.

I doubt it would pass in a popular referendum.

But I don't think it's likely that the amendment that the legislature is inevitably going to push on the people is going to get 2/3. You don't get those numbers outside of the deep south. And Vermont just passed a gay marriage bill the other day (which is going to be vetoed, and there's not a large chance that the veto will be overridden, because they've only got 2/3 in one house, but it definitely means its going to happen in the future), and California may pass gay marriage in 2010. Just like with death penalty abolition, it seems to be gradually sweeping the non-southern states. In 20-30 years it will probably be legal everywhere outside of the deep south.

having only gotten through 1/3rd of that opinion so far, it's a damn well written opinion. I look forward to reading the rest of it tonight.

I rarely read legal opinions but you've piqued my interest.

The fact that it was a unanimous ruling says a lot. Not even Californias ruling was unanimous.
 
It is inevitable and only a matter of time before gay marriage is the law of the land in America.

We are not the barbarians of our history.
