Smith said in a statement after Garland's announcement, "I intend to conduct the assigned investigations, and any prosecutions that may result from them, independently and in the best traditions of the Department of Justice."

"The pace of the investigations will not pause or flag under my watch," he promised. "I will exercise independent judgement and will move the investigations forward expeditiously and thoroughly to whatever outcome the facts and the law dictate."

Smith, a political independent, is also a former chief of the Public Integrity section of the Justice Department.

Biden is not involved. It was all the function of the justice dept. He is not like Trump. Trump deciding to run so damn early changed relationships. The AG turned a couple of cases over to Smith. Just the documents case deals with
Retention of national defense information

conversion of government property

obstruction of justice

Criminal contempt

False statements to federal investigators.
Trump has no defense. He is guilty as sin.

Garland decided when Daffy Donald declared he was running again, it changed things. He turned over 1-6 and classified documents theft over to Smith. Trump is not too bright, but he did come up with running earlier than anyone ever did before would give him some protections. Garland apparently thought so, so he appointed Smith to drill down.
