lol most cities of any size could use a separate phone book only for lawyers. There's plently that would be more than happy to do a two yr. fellowship just to make a living.

I know this is a discussion board and not the real world but the thought of being judged by gov't tribunals and not your peers is frightening to me.

What's more frightening to me is I'm sued for malpractice by John Edwards and it's proven I performed everything according to standard of care and the charlatan is still able to hoodwink a jury into finding against me.
And that bastard used racial bias as part of his game. He specifically favored black clients who birthed children with cerebral palsy, would get all black juries in the poorest counties who would find against the rich white ob/gyn who performed standard of care but was unlucky enough to have delivered a child with CP.

Anyway that drastic a change will never happen so the point is moot.

germany is not america. for decades we've seen american government become so damned corrupt that district attorneys throw snowballs at the gates of hell to a grand jury over a cops crime so they can cover their ass and say they did their job. unless you can completely clean up ALL levels of american government, your solution would never work.

I know. And we have at least two distinct separate americas. A jury of peers would probably work better there than here. Less chance of racial bias in what is still a relatively homogeneous population.

You think a jury of lawyers wouldn't be open to giving a fellow attorney a huge payday?

Seems you forget there's lawyers on both sides of a case.

young attorney's envision themselves being the lawyer winning a future case for big bucks. they have a vested interested in seeing corporations forced to make big payouts. They aren't unbiased in any case

A professional jurist has no interest in an ambulance chaser winning big one way or another unless maybe he's bribed.

He's referring to Louisiana's use of the Napoleonic Code in it's legal system, rather than English Common Law. The number of jurors does not constitute a "different system" the way that the Napoleonic Code does.
