I hear from the left quite frequently that these government agencies that fall under the Executive Branch are "independent", particularly the Department of Justice and the FBI.
Where does that notion come from? I have never seen that codified in law? To claim they are "independent" would imply that they have the same enumerated powers as the Legislative and Judicial branches as well and operate with very little checks and balances.
The truth of the matter is that they all fall under the Executive Branch. The President is in charge of the Executive Branch. As such he has 100% purview over what happens with them. He can decide what cases they try and which ones they do not.
Now for obvious reasons, you do want to maintain the appearance of no conflict of interest, but make no mistake they are not "independent" agencies.
