There is no other option. There no way they can prove pre-meditation.

You only need intent to make murder. I think shooting at someone with a gun usually shows intent to kill.

We can compare this with the Baldwin case. Baldwin was told the gun was not a gun. He was told, and believed that it was harmless. Lorincz knew her gun was a gun. She knew she was firing it. Therefore, she had intent, and it was murder.

As for the stand-your-ground aspect of the case, Lorincz put "no trespassing" signs on property she did not own, and threatened to shoot people who entered that property. That is theft of property through use of a gun, not self defense, even in Florida.
