In a strongly worded opinion, the chief judge of the Foreign Intelligence Surveillance Court expressed consternation at what he saw as a pattern of misleading statements by the government and hinted that the NSA possibly violated a criminal law against spying on Americans.
“For the first time, the government has now advised the court that the volume and nature of the information it has been collecting is fundamentally different from what the court had been led to believe,” John D. Bates, then the surveillance court’s chief judge, wrote in his Oct. 3, 2011, opinion.

so the opinion is it's unconstitutional collections, but the opinion itself is secret......

Yup. And at that time the NSA was still holding back (still is really, even with the "whistleblowers" talking we still don't know the half of it). The reality is, what has since come out would have sent that secret court into an apoplexy of secret tantrums where we would never hear that what was happening was secretly unconstitutional.
 
There is no QUESTION that Obama, Eric Holder, the head of the NSA, the entire Judiciary committee, and probably a few more people should be impeached, removed form office, and from Holder on down imprisioned.

Holder was impeached.. not removed. I think Obama uses him as a stalking horse

for clarification.....reading the opinion, it was not the court's decision that the law was unconstitutional, but that the conduct of the NSA operatives in misrepresenting when applying for warrants resulted in actions which were unconstitutional.....

it is....its interesting that what was originally described as a few thousand minor incidents in error now appears to be around 56,000 a year.......
 
He should have been held in jail. For life.

I'm not a conservative, but I'm not a dogged liberal either, and I hate seeing DoJ being used to push an ideology
