As an attorney, she knew well that she was committing fraud by declaring the Norfollk home as a secondary residence. It was stupid for two reasons:
1. She should have at least made an attempt to reside there part time
2. She should never have prosecuted Trump for something no AG would bother with had Trump not been president knowing full well she had committed fraud herself.
Now it's going to cost her more in legal fees than any amount she saved had she gotten away with fraud.
Stupid.

If proven she did commit fraud, it was incredibly stupid for her to go after Trump . But the plan was not for him to get elected.

What evidence is there that James rented out the secondary home? (I have seen reports that her Schedule E declared between $1000 to $5000 in income for renting real estate.)
How much time must a person spend at a secondary home according to the law? Two days? Six months?

Speculation by somebody with no facts about the case as to what they think should have happened is nothing but pissing on yourself.

Also, the mortgage company/bank is no longer in existence, they sold her loan, so who is being defrauded, exactly?

It is very common for banks to sell loans. Fannie and Freddie were designed to buy FHA loans from banks so they could make new loans. It's the rare loan that ends up being serviced by the original lender for the full time of the loan.

The problem comes in when you actually look at the FHA guidelines for a second home which allow rental income from a second home.

If the lender identifies rental income from the property, the loan is eligible for delivery as a second home as long as the income is not used for qualifying purposes, and all other requirements for second homes are met (including the occupancy requirement above).

Just because there is rental income is not a violation of the rules.
Then the prosecution will have to prove that James never occupied the home at any time during the first year of ownership and never intended to occupy it. Good luck to them to prove that beyond a reasonable doubt when the standard is the jury will have to assume she did until proven otherwise.
