It is good that you are at least trying to learn about this, but I think you are getting confused...

Different states have different rules for gun shows and what must be purchased through an FFL holder. Some require every gun, including long rifles, others only require handguns to be purchased using an FFL holder...By definition any person holding an FFL MUST do a NICS background on every gun in his inventory. He can NOT just give the weapons to a 'friend' and tell him to just write down the guns sold...The rub with gun shows is that private citizens also sell their own private weapons, this can be done without background checks...

But, I believe that you are misinforming when you make it seem as though a Federal Firearms Licence holder can just go to a gun show and sell their weapons unchecked.

Only if they are selling guns that they personally own. They can buy them via their FFL and sell them to themselves, of course. But they are still selling privately owned firearms.

I know a few FFL holders, and every single one has been audited more than once by the ATF. If they are selling their personal firearms, then I seriously doubt they are doing it as a dodge or doing it regularly.

So an FFL holder orders a gun for his inventory. Then this same gun leaves his inventory without a recorded sale or background check, and is then sold by someone else at a gun show??

Do you really think the FFL holder is going to risk prison time to make a few extra bucks at a gun show?

I looked at your links and didn't see anyplace that allowed FFL dealers to not use the NCIC background check system.

I have only purchased 2 guns at gun shows, but both times it was dealers and both times they did a background check. And that is in Alabama.
 
I bought an SKS to plink with...cheap gun, cheap ammo at the time...and an over/under double barrel at gun shows. Both from dealers and background checked both times. 'Gun show loophole' is just like 'class warfare' in that they are both catch phrases that do not present the whole truth. Easy to remember, easy to say, easy to misrepresent.

Now if you put it point blank to most that are not in favor of people owning guns and asked them if a private transaction (be it a trade or outright sale) was OK between citizens, wonder what they'd say?

I also wonder if there is not some confusion concerning the term "dealer" at these gun shows.

If I set up a booth to sell items, the gun show considers me a "dealer", like they would an antiques dealer if it were an antique show. But if they do not hold an FFL, they are simply private citizens selling their personal property.

there is no confusion about the terms. rana, howey, darla, and bijou are all considering ANYONE that sells a gun at a gun show a 'dealer'. this is how they are able to keep the fantasy in their retarded minds that they are right.

I would say, I would like you to have to do a background check, even if you are a private citizen, selling to a private citizen.

the only way to do that would be to have all transactions go through an FFL holder. Which would essentially mean that the only way to sell a weapon would be to get ripped off in the process, like selling to a pawn shop. In any case it is a states rights issue in my opinion.
