If they owe their primary allegiance to another country. Two illegal alien El Salvadorans are just temporary residents the don't have permanent domicile in the US Identical to Elk's parents. Elk's parents could not have an American citizen therefore Elk wasn't an American because he owed his allegiance to another political community that he was a member of.

Elk was born here but wasn't a citizen therefore he couldn't commit treason nor could most Native Americans prior to 1924.
"Subject to our jurisdiction" means that while they are in The United States foreign nationals are subject to our civil and criminal laws. Basic stuff.
