While the Federal Government has sovereign immunity in most cases, I believe this is the exact reason the exceptions were allowed.
 
yeah, he's not gonna lose in court. that is, of course, assuming it ever makes it to court. the DEA will do anything possible to wear this guy down by attrition in order to accept a lowball settlement or drop the suit.

Damn....here I am agreeing with the Poet.....but his logic is right.....same as blaming Bush for the inaction of the Democratic Mayor and Democratic Governor of Louisiana when Katrina hit.....some peoples failures just wind up with the wrong people getting blamed.......

Oh, wait one minute. The problem with Bush lies with "Brownie" and FEMA. Aid was 5 days or more in coming at that was unacceptable. Bush took responsibility as he should have.
When he got on that aircraft carrier, in that flight suit, and proclaimed "mission accomplished", he was an abject fool. President Obama is celebrating his one year victory lap, in getting the ultimate person responsible for 9/11....something Bush promised he'd do, but didn't.

He wasn't blameless though and you know it. There were a lot of unprepared people and a lot of wringing of hands when it came to that mess, when immediate action was required.
 
I'd bet he was willing to tell them anything they wanted to hear to get out of there...

Seriously, the DEA will be paying this kid a ton of cash. And he absolutely deserves it.

It did not help a bit that so much of our Guard personnel and equipment were in Iraq.
I do Blame Bush for that. And the stupit dems that went along with him out of fear of being called unamerican, etc.
