I don't use drugs/alcohol - But do not I want those whom use weed (fairly benign, and has medical uses) to be prosecuted.

The whole relatonship is stiil suspect -weed is stil a federal Schedule 1 drug.

Hopefully this is something that supplants the Colle Memo. I wonder if the USATTY Haag will abondon the case against Harborside?

A medical marijuana dispensary billed as the world's largest cannabis store may stay open while the city of Oakland fights a U.S. government effort to shut it down or seize the property, a federal judge ruled on Wednesday.

There has been a tug-of-war in California between federal and local authorities over cannabis sold for purported health reasons.

In February, Magistrate Maria-Elena James, the same judge who ruled on Wednesday, said the city had no right to intervene in a federal prosecutor's civil-forfeiture action against the Harborside Health Center, which was featured on the Discovery Channel reality TV show "Weed Wars."

The city appealed the ruling, and James's latest order allows the dispensary to continue to sell marijuana to individuals carrying a doctor's recommendation while the appeal is under review. James called the question of Oakland's legal standing in the case "a matter of significant public interest."

Attorney Cedric Chao, who is representing the city in the case, called the ruling "very significant."

"The court has recognized that Oakland has legitimate interests in protecting its residents' health, in promoting public safety, and in protecting the integrity of its legislative framework for the regulation of medical cannabis," Chao said.

"Today's order, coming right before the July Fourth holiday, reminds us all that one of the strengths of our country is its independent judiciary."

Harborside's landlords have moved to evict the store under pressure from federal prosecutors, who have threatened to seize the property as part of a U.S. government crackdown on what it deems to be illegal pot shops in California.

The city of Oakland in October sued the federal government in an effort to allow Harborside to continue selling marijuana to its 100,000 patients. Oakland officials warned that a shutdown would lead to a "health crisis."

The city expects to collect $1.4 million in medical-pot sales tax revenue this year.

A representative for the U.S. Attorney's Office in San Francisco was not immediately available for comment.

Federal authorities in recent years have launched a crackdown in California and other states against what prosecutors consider an illegal network of cannabis suppliers established under state medical marijuana laws.

California was the first to legalize pot for medical purposes, and nearly 20 other states and the District of Columbia have enacted similar statutes, though marijuana is classified as an illegal narcotic under federal law.

I don't use the stuff anymore....well, I lie....every couple of years if offered, I'll test the waters. But it always makes me paranoid...almost the point of panic attack....has been that way since I was about 23. Before that? I was fine with it...I enjoyed it. I don't know what switch got flipped in my brain, but something changed.

Anyway...I'm glad for you folks that do like it.

I won't smoke anything, but have no objections to consuming in foodstuff. But haven't done it since high school, since it's not worth getting busted when alcohol is legal....

(but yes, it should be legal and anyone who wants to consume it should be able to! well, if they're of legal age, whatever that may be for pot...)

People who are against this are too worried about the idea that we're going to become some kind of "stoner nation" as a result of legalization.

I don't think habits will change. I'm in my 40's, and MOST people I know smoke. They don't smoke irresponsibly, and they aren't couch potatoes. Most are hard working people who like to unwind on weekends, as others would with a beer or gin & tonic.

What legalization WILL change is so many young lives tragically sidetracked & even lost because of incarceration due to minor offenses with marijuana.

It's about our priorities as a nation - who do we want to be? Do we want more people in prison for essentially harmless actions?

The floodgates are kind of open now, like it or not. With the feds laying off, more states are going to follow CO's lead, and it's only a matter of time before pot is legal just about everywhere.

I think just like alcohol, unless prescribed.

The problem I have with dope, at least over here in Europe, is that much of it now is skunk which has a much higher percentage of THC.

What about skunk and other stronger varieties?

The amount of the main psycho-active ingredient, THC, that you get in herbal cannabis varies hugely from as low as 1% up to 15%. The newer strains, including skunk, can have up to 20%. The newer varieties are, on the whole, two or three times stronger than those that were available 30 years ago. It works more quickly, and can produce hallucinations with profound relaxation and elation – along with nervousness, anxiety attacks, projectile vomiting and a strong desire to eat. They may be used by some as a substitute for Ecstasy or LSD.

Legally, these strains remain classified Class B drugs. While there is little research so far, it is likely that these stronger strains carry a higher risk of causing mental illness. A major study currently underway, has already reported problems with concentration and short-term memory in users of stronger types of cannabis.
