Ok I have no idea about the actual answer, so here's my guess. No, because the gathering of evidence is proving of facts, the determination of guilt or innocence follows from those facts, but somebody does not need to be imprisoned for evidence to be gathered.

oj was arrested...and charged :pke:

O.J. was convicted by the press and all of humanity until he was arrested and a dozen people let him go.......so, what were the "facts" of the case.....what happened or what a jury decides happened........
