No. There's no reason for a Conservative to do this. However, it is a typical MO for a Leftist.

It is one of those means, motive, and opportunity sort of things.

Conservative judges only hire conservative clerks, so only conservative clerks would have had the means and opportunity to get the draft opinion being prepared only by conservative judges. Moderate clerks would not have the means or opportunity.

A moderate clerk would want this to be sprung on everyone as late in the election process as possible. That gives Republicans the least amount of time to respond. Conservative clerks would want this as early as possible, so Republicans would have the most amount of time to find a successful response.

But most importantly, a conservative clerk would want this passed the point of no return. Without the draft being released, the Conservative judges could have altered it to soften it. We know they were getting political advise on how to soften it. A conservative clerk (a true believer) would not want it softened.
 
I say yes. There is nothing for Democrats to gain by leaking this document. Americans are opposed to overturning Roe v. Wade. Therefore public opinion is not going to change the minds of any of the Five Fucktards that make up the majority of the court. So the most likely reason for leaking the documents was to keep the pressure on those justices NOT to change their minds in some back room deal. And Republicans are dishonest and lack integrity. So it was obviously one of their own that did this.

If it was a Republiqan I'd say that they just shot themselves in the foot. This is going to galvanize the (D) voters. I received seven pleas for donations via email just yesterday, all of them referencing the leaked maybe-decision.

But your assertion that there is nothing for Dems to gain is absurdly naive. Indeed, there is a LOT for Dems to gain here, first off to create a backlash and threat that will make people like Roberts buckle and decide not to support the overturn. Second, it creates a lot of heat in their base, gets some fire under their asses, because they know that the midterms are going to be a big rout for their party unless something like this comes out.

That's my suspicion as well.

I don't know if the leaker is (D) or (R) -- about the only for sure thing I can surmise is that they do not agree with the maybe-decision and wanted to cause an outcry.

The draft opinions are sent around the court to all the justices, you nitwit. Do some basic research. They regularly create and send around draft opinions and very often votes change as the justices read the draft opinions and they change their minds, think of new arguments, etc. And this wasn't an opinon 'being prepared', it was an opinion circulated around the court in FEBRUARY.

What makes you think Roberts supports the overturn?
 
Could be either. I can see the gain for either side.

Probably someone on the left if I had to speculate - get the '22 campaign going early.

I would think that very few people had access to the draft- and if an investigation is started to determine who spilled the beans- it would be pretty easy to nail down the leaker!

The proposed opinions are sent to all the justices. The draft opinion are only passed around the preparing justices.

This leak has locked the decision into place. It really cannot be undone now. The political considerations have been cut out of it. Whoever did it wanted this opinion to be the final opinion.
