In fact it is. Disney was stripped of they power to govern by the laws of the State Of Florida. In a midnight action, Disney attempted to create a contract with itself to preserve powers in direct contrast to law created by the elected representatives of the state.
If Disney can judge shop enough to find one they own, then they might win a lower court ruling. Which I think is their plan - buy time. They will lose on appeal as there aren't appeals courts in their pocket anymore.
