Lee Zeldin attacker quickly released from jail — just as pol predicted


The man who allegedly tried to stab Republican candidate for New York governor Lee Zeldin with a bladed weapon during a campaign stop on Thursday was released from jail within hours of his arrest on a felony charge — just as Zeldin had predicted.

David Jakubonis, 43, from Fairport, New York, was arraigned overnight in Perinton Town Court on a count of second-degree attempted assault stemming from the attack on Rep. Zeldin but was quickly released on his own recognizance.

County, Zeldin, who is running as a tough-on-crime candidate against incumbent Democratic Gov. Kathy Hochul, said he expected his alleged assailant to be back on the streets in no time.

“His words as he tried to stab me a few hours ago were ‘you’re done’, but several attendees, including @EspositoforNY, quickly jumped into action & tackled the guy,” the gubernatorial hopeful tweeted early Friday. “Law enforcement was on the scene within minutes. The attacker will likely be instantly released under NY’s laws.”

I dont know countrywide but in Florida if you have a felony conviction you cant be a licensed bondsman. so much for being a "criminal" if you are arrested you already are subject to probable cause. Bail is a constitutional right, but it's balanced against the public safety and your likelyhood to appear
and the severity of charges determines the bail.. Even NY and CA do have more then cashless bail
If this whack job was charged a little higher, like first degree assault he would have gotten more then own recog.



bail bondsman are only interested in if you appear or not.
The function of bail is to assure your appearance , repeat offender or not. If you keep getting arrested and keep getting appearing for charges, sure you get bail. you MUST as it's a constituional right with some exceptions for grievous charges


bail is not a "fine", it's a surety bond.

So what you are saying is that rich people should be released, and poor people should be stuck in jail. What makes matters worse is that prosecutors use technicalities to extend trial dates when poor people are stuck in jail. There have been a number of cases where people are kept in jail for years longer than if they had just plead guilty, and then it is discovered there is no evidence against them.

The difference between us is that you think that wealth should be the deciding factor, and I think probability of continued crimes should be the deciding factor.

If this is so, cash bail would have been even more unfair. Imagine paying money to get bailed out of local jail, just to go to federal jail immediately. It really happens, and you do not get a refund.

What someone is charged with is decided by the prosecutor, and bail is decided by the judge at the arraignment.

The Sheriff, Todd Baxter, could not get the nomination from his party, Republicans, so switched parties. Baxter has campaigned for trump. The rest of the sheriff's department is heavily Republican, because Baxter is the first Democrat elected sheriff since the 1800's.

The point we keep coming back to is that if a judge orders someone released, the police have to release him. You might make the super technical argument that the police released the suspect, but the reality is the authorization to release the suspect comes from the judge.

If the suspect was "released" to federal custody, then I think Althea has asked a reasonable question. So what? It is not like he was actually free.

It appears I made a mistake when I thought he had been released to go free. I am man enough to admit it.
