This evidence is irrefutable:
He was in the US illegally.
He is a citizen of El Salvador
He had four outstanding warrants for failure to appear for traffic violations
He had restraining orders against him for domestic violence against his wife
There are multiple sources that confirm his being a member of MS 13, a legally declared terrorist organization in the US.
What's at odds now is:
With his being in a terrorist group, does his protected status stand up still? It was granted at a time when MS 13 was not so designated. Can a district judge overrule the executive and executive branch on national, domestic, and foreign policy?
I suspect, that "due process" in this case won't fly when this hits the supreme court. In fact, my suspicion is that the supreme court will come down hard against district judges issuing national edicts, against them widening cases to class action status without standing, against them making national, domestic, and foreign policy decisions.
This is coming to a head, and I don't see district court judges coming out of it unscathed.

More likely, it never existed to begin with. After all, it was only when faced with the threat of actually being deported did this thug start trying to avoid it. He had plenty of time earlier to appeal his order of deportation, but didn't care when he knew he wasn't really going to be deported.
