Neely, carrying on in a subway was intimidating, but the INITIAL reports did not having him try to extort money from any particular passenger with the threat of violence.
It will remain to be seen if Penny gets something akin to "justifiable homicide" ... most likely second degree manslaughter. How that is meted out by the judge is another speculative situation.

That's not how the justice system works in the US. You don't sum a bunch of misdemeanors and then choke someone to death in public as punishment.
So, what did he do on the day in question, that would be threat on someone's life and would justify Penny using lethal force?

The strawmen are out in full force this morning. The issue is NOT that he intervened and helped restrain someone who was acting erratically until the police arrived. The issue is that, in the process of restraining that person, he KILLED them.

There were no victims on the subway. It's debatable whether he even broke any laws besides littering. He did not deserve to die and wouldn't have if not for Penny. But, hey, you don't think Bragg is doing his job correctly, so human life magically becomes less valuable and other laws, i.e. homicide/manslaughter, suddenly become irrelevant.
