court nullifies democracy

courts have their role to play in the structure of our government. Just like I would want the courts to overturn many of the laws gungrabbers have made. my guess is the ban on same sex marriages violated the 14th amendment
 
Im not for gay marriage but courts and judges been doing this forever, gay marriage is just the newest thing

Does the 14th protect one's right to something ficticious, such as a made-up definition?

Why should this even be decided by vote? Re: the Marshall-Newman Amendment,voter turnout was 52.66% and of that percentage 57% voted to ban gay marriage. This isn't representative democracy.

desh doesn't believe in representative democracy though. she's long been a proponent of majority rules. and if you don't vote, then nobody has a right to bitch or complain later. voter turnout is the peoples problem, not the courts.

I wasn't talking about Desh. I want to know why you think this law shouldn't be overturned, if indeed that's why you started the thread.

because the pols didnt want to have to come down on one side of this issue and voting "present" as the president so shamefully did so often was no option here in Va. its not uncommon to leave matters of import to referrendum.
