He could have been prosecuted for Pentagon Papers. The court only ruled the government could not prohibit the newspapers from printing the documents (which were copies). Government tried to get an injunction rather than charging Ellsworth for some crime related to national security.

In this case, P.Veritas typically takes information and doctors it in order to fabricate lies.

Whistleblowing for a valid cause is different, and even then nobody should go full Snowden for obvious reasons

I doubt it. Unless they can prove that Project Veritas knew the diary was stolen, there's really no case here. That's going to be hard to do. Unless the government has outside corroboration, the word of two felons against that of Veritas is a wash at best. It's 'he said, she said.'
