march 13 2016 Although Ralph Gilbertsen has never been arrested for domestic abuse, is not a felon, and has never been deemed a danger to himself or others, cops in Richfield, Minnesota confiscated his firearms.

The 74-year-old former Marine and security worker has a state-issued carry permit and is now suing in attempt to get police to return the three legally acquired handguns they removed from his home last May.

Gilbertsen believes in Bigfoot, UFOs and receives treatment for a “mild” mental health disorder. Police were alerted to him after people at his apartment complex reported that he frequently brings up government conspiracies and expresses concerns that the CIA is spying on him.
 
Therein lies the problem with the "mental health" exception. It would most assuredly be abused by the left to confiscate out guns. It must be fought as there is nothing reasonable about it

On page two of the Texas driver's license application is this question: "Within the past two years, have you been diagnosed with, been hospitalized for or are you now receiving treatment for a psychiatric disorder?"

The Texas Department of Public Safety has by law probed applicants' mental health since the 1970s as part of a process to decide who gets a license.

Virginia asks would-be motorists if they have a "mental condition" that requires them to take medication.

Florida and Ohio want to know if applicants have conditions they believe could impact their ability to drive safely.

All that posturing the NRA does about improving diagnosis and treatment for the mentally ill is just smoke and mirrors?


Since 1966, the National Rifle Association has urged the federal government to address the problem of mental illness and violence. As we noted then, “the time is at hand to seek means by which society can identify, treat and temporarily isolate such individuals,” because “elimination of the instrument by which these crimes are committed cannot arrest the ravages of a psychotic murderer.”

More recently, the NRA has supported legislation to ensure that appropriate records of those who have been judged mentally incompetent or involuntarily committed to mental institutions be made available for use in firearms transfer background checks. The NRA will support any reasonable step to fix America’s broken mental health system without intruding on the constitutional rights of Americans.

Federal Law

Since 1968, federal law has barred the possession or acquisition of firearms by anyone who “has been adjudicated as a mental defective or has been committed to any mental institution.”

The Bureau of Alcohol, Tobacco, Firearms and Explosives has issued regulations that define an “adjudication” as a “determination by a court, board, commission, or other lawful authority that a person is, as a result of marked subnormal intelligence, or mental illness, incompetency, condition, or disease: (1) Is a danger to himself or to others; or (2) Lacks the mental capacity to contract or manage his own affairs.” This includes a finding of insanity or incompetency in a criminal case.[3]
