This case will eventually find its way to the supreme court, where a 5-4 majority will rule against the ninth circuit. I don't like it but that's the way its gonna be.
The fact that the are human individuals with rights does though. They just want to be people withe right to live the way they choose, not based upon anyone else's religious beliefs.
????? And....somehow gays have convinced themselves that this cant be achieved without government endorsement, tax breaks and governmental entitlements?
imo...i think it will not turn out that way
there is ample precedent for the court to find in favor of gay marriage.
heterosexual couples are the only couples who can produce biological offspring of the couple

We are dealing here with legislation which involves one of the basic civil rights of man. Marriage and procreation are fundamental to the very existence and survival of the race

The institution of marriage as a union man and woman, uniquely involving the procreation and rearing of children within a family, is as old as the book of Genesis...
http://www.cas.umt.edu/phil/faculty/Walton/bakrvnel.htm
it is not surprising that the decision to marry has been placed on the same level of importance as decisions relating to procreation, childbirth, child rearing, and family relationships. . . .
it would make little sense to recognize a right of privacy with respect to other matters of family life and not with respect to the decision to enter the relationship that is the foundation of the family in our society
http://caselaw.lp.findlaw.com/cgi-bin/getcase.pl?court=US&vol=434&invol=374
But as Skinner, Loving, and Zablocki indicate, marriage is traditionally linked to procreation and survival of the human race. Heterosexual couples are the only couples who can produce biological offspring of the couple....
And the link between opposite-sex marriage and procreation is not defeated by the fact that the law allows opposite-sex marriage regardless of a couple’s willingness or ability to procreate. The facts that all opposite-sex couples do not have children and that single-sex couples raise children and have children with third party assistance or through adoption do not mean that limiting marriage to opposite-sex couples lacks a rational basis. Such over- or under-inclusiveness does not defeat finding a rational basis....

what? from what i've seen, read and talked with friends, gays only want EQUAL rights.
And I don't know what you're talking about has to do with anything. Here in America we give superior rights to the married, not equal. In 44 states to heterosexual couples because they are the only couples who procreate. In 6 states, also to gay couples because they rub genitals just like a real mom and dad....although I dont know what rubbing genitals has to do with anything.
What planet are you from?

"In a major victory for gay rights activists, a federal judge ruled on Wednesday that a voter initiative banning same-sex marriage in California violated the Constitution's equal protection and due process rights clauses.
After a five-month wait, 9th Circuit District Court Judge Vaughn Walker offered a 136-page decision in the case of Perry v. Schwarzenegger, firmly rejecting Proposition 8, which was passed by voters in November 2008."
You know what they say, "those hating on gays, have something to hide".
More proof that the left is totalitarian. To hell with the will of the people.

It's about damn time. The only thing that is surprising is how long it took to render the decision.
