MEMORANDUM FOR THE ATTORNEY GENERAL
SUBJECT: Application of the Definition of Machinegun to "Bump Fire" Stocks and Other Similar Devices
After the deadly mass murder in Las Vegas, Nevada, on October 1, 2017, I asked my Administration to fully review how the Bureau of Alcohol, Tobacco, Firearms and Explosives regulates bump fire stocks and similar devices.


Although the Obama Administration repeatedly concluded that particular bump stock type devices were lawful to purchase and possess, I sought further clarification of the law restricting fully automatic machine guns.


Accordingly, following established legal protocols, the Department of Justice started the process of promulgating a Federal regulation interpreting the definition of "machinegun" under Federal law to clarify whether certain bump stock type devices should be illegal. The Advanced Notice of Proposed Rulemaking was published in the "Federal Register" on December 26, 2017. Public comment concluded on January 25, 2018, with the Department of Justice receiving over 100,000 comments.


Today, I am directing the Department of Justice to dedicate all available resources to complete the review of the comments received, and, as expeditiously as possible, to propose for notice and comment a rule banning all devices that turn legal weapons into machineguns.
Although I desire swift and decisive action, I remain committed to the rule of law and to the procedures the law prescribes. Doing this the right way will ensure that the resulting regulation is workable and effective and leaves no loopholes for criminals to exploit. I would ask that you keep me regularly apprised of your progress.
You are authorized and directed to publish this memorandum in the "Federal Register".

It is a PR move, any time you see "review" when it comes to gun regulation it means stall, today Huckabee must have used the phrase "we are in the process," "it is in the process," "the process is....," just like, "review," means little

Only real addressing of bump stocks has to be done legislatively, if he meant what he said, he would have recommended to Congress they do something and then follow thru on his request

and even fully automatic machine guns are not illegal to own....but that don't mean this type of modification can't be made illegal

snarky, but true....even a president can do little to ban a particular gun or device without the approval of Congress and a law enacted...
 
It doesn't matter what bump stocks do or don't do they are gone, to satisfy they gun grabbers...next the gun grabbers will be after the AR15 and
severe background checks...The reboobcons will have to be careful here the red necks get pissed of easily and if you piss them off they don't vote.

The word ‘assault’ is a verb.

Regardless of who uses it. You can put the word ‘assault’ in front of ‘shovel’ to make ’assault shovel’. See how easy that is?

You can put different kinds of handles on them so they look different than other shovels; then put them on magazine covers to market them as ‘assault shovels’ and make some money.

But when it’s all said and done, it’s just a shovel—until you assault someone with it.

ATF was “not allowed to physically examine the interior of the weapons” recovered from the Las Vegas shooter’s hotel room, a new Freedom of Information Act production by the Bureau of Alcohol, Tobacco, Firearms and Explosives reveals. The baffling revelation appears on page 335 of a response sent to attorney Stephen Stamboulieh as part of an ongoing production of documents responding to his FOIA request.

This leads to another problem for those intending to challenge any finalized rule ATF issues on banning “bump stock”-type devices.

“ATF did not disclose that they had not examined the firearms prior to promulgating the rule,” firearms designed and Historic Arms, LLC President Len Savage notes. “And now that the comment period is closed should they go forward with this rule under the Administrative Procedure Act that information can not be used in a court challenge because it was not submitted prior to closing of comments.

“DOJ is manipulating the APA to make sure that information will NOT be used to shoot down the rule,” Savage concludes. “Does ATF prosecute its firearms cases like it promulgates rules, without ever looking at the evidence? ATF is currently attempting to criminalize an industry and a large swath of the population and NEVER looked at any evidence? They claim they were ‘not allowed'? By whom?”
