This was no "accident." He didn't want to stop at the red light so he deliberately drove onto the wrong side of the road to get around the cars in front of him. Then he ran the red while speeding and killed the mother. They let him plead guilty to a misdemeanor!!!

On Tuesday, Gerardo Lopez pleaded no contest to vehicular manslaughter and reckless driving — both misdemeanors — in connection with the March 5 death of Jessica Fodge. The 31-year-old mother had just walked her children to school and was on a sidewalk near University Center Drive and East Twain Avenue when a Chevrolet Trax compact SUV ran a red light, made a wide turn, drove into the curb and hit her, according to her family and police.

Lopez appears to have a physical disability that caused him not to hit the breaks correctly, or so he claims. Prosecutors could not disprove that, so that is what we are left with.

I am not sure I believe him, but if it is true, it was an accident. It was the opposite of deliberate.

Well of course he says that, you idiot. But it's still his fault. If he can't use the brakes, he shouldn't be driving. THINK

If he suddenly cannot use the breaks, it is not his fault. It is bad luck.

I am not sure I believe him, but there is not enough evidence he is lying. The prosecutor decided to go for a plea bargain, because he did not think he could prove a felony beyond a reasonable doubt.

So your own article presents the possibility he lost control of the car, due to causes beyond his control, and therefore did not intentionally run the red light. I have my suspicions that might not be true, but I like the prosecutor, and you, cannot disprove the defense's claims.
 
Article says the killer was not drunk driving but no one believes that. All hispanics are DUIs.
The initial assumption he was drunk ruined the case. The police reports all read that the defendant had lost control of the car, due to alcohol or drugs. When all the tests came back negative, they were left with the defendant lost control of the car. It reads as an accident, so not a crime. He had a sudden medical problem, which caused him to lose control of the car.

Had the police not made assumptions, and left the reports more open to it being an on purpose(rather than an accident), the prosecutor would have had a stronger case.
