When did the woman first discover that her ex-husband was at home? That's actually kind of a moot point, because regardless if she knew he was home or didn't know, if she wanted to go into the home, she probably should have notified law enforcement at the very minimum. This was probably even a requirement of her restraining order against him (I'm just speculating, I have no idea what was in the restraining order). As far as just firing a shot into a wall, I know of no state in the union that includes as part of its use of force continuum, the firing of a "warning shot". The police don't use warning shots and there's a good reason for it, because no matter how well trained you are with a firearm, once you've pointed a gun at anything other than its intended target and pulled the trigger, you don't really know where that bullet is going to end up. It's called the unlawful discharge of a firearm. Florida has had another gun law on the books for quite a while now and I believe it's been fairly successful, it's called 10-20-life. Use a gun in the commission of a crime, 10 years. Pull the trigger on the gun during the commission of a crime, 20 years. Kill or injure someone with a gun during the commission of a crime, life in prison. Her "crime" for lack of a better word, would be violating the terms of her own restraining order, and pulling the trigger on the gun was what got her the 20 years. As far as the white guy goes, there are probably jurisdictions in this country that would've let him off if he had shot his wife too. (Some people just don't take too kindly to adultery!). All that being said, I hope the woman's lawyer is savvy enough to find some grounds for an appeal, barring that, I hope she can be paroled quickly.

As far as the guy who shot the man having sex with his wife - back to patriarchal times. Guess the jury thought he "owned" his wife so it was ok to kill someone who was having sex with her.

Both cases were here in good ol' Floriduh. The Alexander case is in Jacksonville, so I'm familiar with it.

My opinions:

The stand your ground law here sucks and needs to go away. We're working on that.

Alexander doesn't apply under stand your ground. She's a battered wife and should have been acquitted based on that. Unfortunately, Florida doesn't have battered wife laws and as I've explained before with my next door neighbor, it's hard as hell to get a conviction.

No way does stand your ground cover an idiot shooting another idiot screwing his wife. That's at a minimum, manslaughter.

She is guilty, its the the mandatory minimum sentence law that led to an unjust sentence....but the prosecutor is the same ass that brought charges against
Zimmerman, so she might be a little loony too.

Huh...I thought the 'rape' case was in Texas? Maybe that was different.

And the adultery case was supposedly a rape case. Even though nobody in the courtroom believed that claim.

Honestly, I tried to avoid reading this thread.

Shame on me. Everytime I posted today, I looked at the thread title .. then avoided it.

But I have to be in the proper frame of mind to take these kinds of atrocities now. I have high blood pressure, it killed me in 2007 when I had a stroke and hemorrhagic seizure. Yup, I died from it .. revived in the ambulance, but didn't wake up for the next 4 days .. spent 4 weeks in the hospital. Amazingly, I came out of it with no visible signs of a stroke and no impediments.

Point being .. I've lived my entire life watching, reading, and listening to shit just like this. My entire life.

We still aren't considered fully human after more than 400 years in this country. Prisons in America are packed full with black people who got prison while whites get probation for committing the same crime .. a truth that has been studied, documented, and proven beyond all reasonable doubt .. and we are no closer to that changing. My children face the same risks and dangers from the criminal Just-US system that I did in the 60's.

White people never demanded that this criminal system be stopped.

No words for what I'm feeling .. which is why I avoided this thread.
