When the control of Congress is held by the same party as the President, nobody in their right mind would expect them to act faithfully to keep him in check.
The courts say what the President can and cannot do.
The DOJ, if it's functioning the way it was meant to and always did prior to trump coming in and fucking it all up, is supposed to enforce what the courts deem constitutional or unconstitutional.
