Yes.
Only the woman can ultimately choose to terminate a fetus that will eventually become a child.
If she wants to keep that Fetus and allow it to develop into a baby, society recognizes rightly that anyone who kills that Fetus within her, against her will is not only killing her Fetus, but is killing the Child she was allowing to develop within her.
This is not unique in law.
If i enter a construction site, i am barred from entering, because i oppose the big new project being built, and I deliberately destroy all of the construction materials, I am not just liable for the cost of the materials, but also for the cost incurred and damage to the yet to be finished (born) project. Even though the new building does not exist yet the law can and does recognize the future harm i have done.
If those same construction materials were just sitting in a yard idle and not ear marked for any use, and i destroyed them I would only be liable for that specific damage.
so this big attempt at a gotcha religious nuts always try, falls flat. The law can and should recognize the mothers view on the future viability (or not) of a Fetus as she decided if a zygote will be allowed to develop into something that is protected.
