I believe there is a concept called mens rea in American law. If a strong enough case can be made that one had a "guilty conscience" or a sense that what they were doing was WRONG it is a crime, but if something is done without malintent it can be adjudicated differently.

We don't give someone the death penalty if a coworker suffered an accidental death due to a mistake, for instance.

I think both Biden and Trump should be prosecuted the full extent of the law with regards to mishandling classified materials. Trump should further be investigated to understand why he actively fought AGAINST returning the documents and then attempt to HIDE others. And then there's the whole "empty folders" to discuss.

They are two different cases with different levels of malintent implied or explicitly practiced that will make the final determination of how they are adjudicated.

Why would they need to do that? Biden has been cooperating. The reason for the raid was after 18 months Trump was not complying, so the FBI moved in to take possession of the documents. It was not a raid.
