When you go into the Whitehouse you are informed of what procedures you have to follow. What you have to do in classification is explained clearly and they make a point of it. Trump did not have the power to classify in his "big brain". He had to follow the normal procedures which included a conference with the departments that are impacted by the change.
If the president had that power, we would have no classification system. A person in government would have to call the president if they used any document. Then call him again in case he changed his "mind". There are many millions of classified documents. The president would just spend all day, every day, responding to classification questions. He would not have time to play golf.
Nobody would ever know what is classified. The argument that Trump could just wish them classified or not is extremely stupid and wrong.

Very well thought out. Also, if Trump had the power to classify them in his mind, how do we know Biden didn’t reclassify them in his mind the second after he took the oath of Office.

Plus Trump NEVER declassified any of them. None of his lawyers have made that claim in any court filing, as they know declassification involves a process, Trump never submitted to.

While a POTUS can declassify anything he wants, save a small handful of documents where he does not have that power, declassification is not a magic process. Even the POTUS has to follow a process to declassify anything he wants.

And Trump knows the above.

There are three cases, that went to court, where Trump claimed he had declassified documents on Twitter, or a news program, and when the Media then sued under FOIA to get them, Trump sent the White House lawyers in to court to say 'yes Trump wrote or said they were declassified but he NEVER followed thru with the necessary declassification process, and thus they are not declassified and the media cannot have them'.

In all three instances the COurts agreed, that Trump writing (Twitter) or saying (on the NEws) that something is declassified IS NOT ENOUGH and the doc's remained classified.

So to argue that Trump via thought can declassify when Trump himself argued him 'writing' or 'saying' in public something is classified IS NOT enough, is just Magat stupidity.
