Two things are clear right now:
1. Pretti was armed and the weapon, holstered was visible to ICE agents. Pretti was moving towards the agents and their vehicle.
2. Pretti resisted arrest.
This isn't to say whether his shooting was justified or not, but it is 100% clear that Pretti created the conditions where his shooting became a possibility.
