Amanda Knox Found Guilty (Again) part II

Don't have any solid opinions about her quilt but it's obvious that Italy doesn't have the same standards of jurisprudence as the US does as some of the legal prosecutions would violate US Constitutional law.

What I'm interested in is will the US permit her being extradited to Italy to serve her sentence?


Exactly and what are the reprocustions if we don't?
 
I think that if these things are not decided within six months, the accused should go free.


We do have provisions in the Florida and I am fairly sure all States, that if you demand a speedy trial, the Court must bring you to trial within a time frame or the charges are automatically dismissed. Most people waive that right because they need more time to prepare for a trial, or they hope that with time the Prosecutions case will fall apart.

If I go into a bank and brandish a gun, demand money, and shoot the guard dead... the same acts would violate a variety of crimes. Some of those crimes federal and some state. The Fed's can prosecute what they want, and what they don't prosecute the State can prosecute. So, for example, the feds could be prosecute me for bank robbery and chose not to prosecute me for Murder. (Lets just say the State punishment for murder is more severe...) The State can still prosecute me for murder, even if a jury finds me not guilty of bank robbery.

and in that instance, yes, there are two crimes. robbery and murder. that is not what i'm referring to though.

the government can charge a defendant with both a crime and the conspiracy to commit that crime without violating the constitutional prohibition on double jeopardy. This gives the government two opportunities to convict for is essentially the same offense.
